A person liable for military service in Ukraine can receive agenda even through his employer, in which case the latter is obliged not only to inform him about this, but also to control his appearance at the military registration and enlistment office.

This was told by lawyer Kirill Kazak, reports The Page.

According to him, upon receipt of the summons, the employer must issue an order notifying those liable for military service of the need to appear at the territorial recruitment and social support center (the former military registration and enlistment office). After that, the document must be notified to the persons to whom it applies, as well as to ensure attendance.

“The head of the enterprise is obliged to control the arrival of a person liable for military service at the TCC. In case of non-appearance, he must inform the military registration and enlistment office that his employee did not appear at the appointed time,” the expert said.

The sequence of actions of the employer looks like this:

  • issue an order to notify conscripts and those liable for military service about their call to the TCC and the joint venture;
  • bring the order to the attention of conscripts in terms of ensuring their arrival on a call to the TCC and the joint venture;
  • send a copy of the order to the TCC and the joint venture within three days;
  • control the results of the notification and the arrival of conscripts and those liable for military service in the TCC and the joint venture.

In case of refusal to sign the order, the employer draws up an appropriate act in the presence of three people. The document is then sent to the TCC.

If the representative of the company/enterprise does not want to hand the summons to the employee, he has two options:

“Firstly, it is possible that the employee is absent for a good reason, for example, he is on sick leave. The second option is failure to serve the summons due to the dismissal of the employee. In this case, the employer must contact the military registration and enlistment office and explain that he cannot serve the document on this reason. Of course, these are temporary measures. If the military registration and enlistment office wants to call a person, this will not be an obstacle to ensuring his presence, “the lawyer explained.

As UNIAN reported earlier, President of Ukraine Volodymyr Zelensky responded to an electronic petition to ban issue summonses to people at checkpoints, gas stations and on the street.
