The newly created State Inspectorate for Architecture and Urban Planning (GIAG), which came to replace the corrupt State Architectural and Construction Inspectorate (GABI), catastrophically worsened the situation for ordinary citizens and small businesses building CC1 (minor liability class, – ed.). About it declares urban planning expert Georgy Mogilny.
“As a result of the reform with the creation of the GIAG, conditions have improved for large businesses building objects of consequences classes CC2 and CC3 (10% of all construction projects), but the situation has catastrophically worsened for ordinary citizens and small businesses building CC1 (90% of all objects)” – the expert emphasized.
He recalled that hopes were pinned on the newly created State Inspectorate for Architecture and Urban Planning for the complete cessation of illegal actions when registering messages about the start of construction work.
There were a number of prerequisites for such expectations:
- a completely new body, created specifically to overcome the corruption that was in the GACI;
- the illegality of the return of messages as one of the corruption schemes of the work of the GASI was identified and confirmed by a specially created VSK VRU, so the GIAG had to take this into account;
- in contrast to the GASI, the GIAG had full authority to exercise both architectural and construction control and architectural and construction supervision;
- Semyon Krivonos, the head of the SIAG, was a great supporter of the ideas of liberalization and deregulation of the economy, and before his appointment he headed the Office of Simple Solutions and Results of Mikheil Saakashvili, so the corrupt transformation of the message into a document of a permissive nature directly contradicted his public position;
- and most importantly: EGESS passed the stage of a pilot project and began full-fledged work, which tritely made it impossible for actions not provided for by law, because “the computer does not take bribes.”
However, with the beginning of the work of DIAG, the exact opposite of expectations happened.
The share of illegal returns of messages for revision in the GIAG is on average 2.5 times higher than the indicators of the corrupt State Architectural and Construction Inspectorate, and in the bodies of state architectural and construction control (SACC) under local governments, the share of refusals jumped three times.
All this happens quite openly and can be traced through the public state system. But the same politicians and high-ranking officials who spoke about the situation with the return of messages as evidence of the corruption of the GASI, “do not notice” this and talk about the complete absence of corruption and the excellent work of the GIAGciting successful examples of reducing the number of failures and the speed of issuing permits for construction of consequences classes CC2 and CC3.
In some cities, the situation looks absurd. For example, the department of the GASK of the Kyiv City State Administration makes more than two returns for revision for each active message. And in the GIAG, for the complex construction of CC3, when obtaining a permit for two issued permits, there is approximately one refusal. Therefore, it is four times more difficult to start construction of the lowest liability class CC1 in Kyiv, with its complete deregulation, than the construction of the highest class of consequences CC3, which requires obtaining a permit.
According to the expert, the hands of ordinary performers were untied order number 107 (Annex 5), signed Head of GIAG Semyon Krivonos on the first day of the new body. On September 16 last year, he approved the Information Card of the administrative service for registering a message. And this information card at the same time establishes that there are no grounds for not providing the service, but as a result of the provision of the service, you can receive a notification about the return of the document for revision.
Thus, Semyon Krivonos personally allowed his subordinates to grossly violate the laws of Ukraine and return them for revision, which was subject only to registration in the EGESS.

Recall in September 2021, the Government at its meeting finally liquidated the State Architectural and Construction Inspectorate (GACI). Since that time, the State Inspectorate for Architecture and Urban Planning (GIAG) has been working in this area.
How Minregionstroy reportedafter four months of work of the newly created body GIAG, more than 1,500 permits for the start of construction work were issued, more than 500 certificates for the acceptance of objects into operation.
During the same time, the GIAG refused to grant permits for the start of construction to more than 600 entities, and almost 700 refusals to obtain certificates were issued due to violations.
Thus, even according to official statistics, the number of failures in the first four months was 65%.
Nevertheless, Alexei Chernyshev, Minister for the Development of Communities and Territories, commented on these statistics in an absolutely optimistic manner.
“Thanks to digitalization, administrative services in the construction industry are now provided promptly and transparently. The waiting time for a response to the application of the construction market participants has been significantly reduced, as well as the time for checking the object before putting it into operation. Almost 100% of applications are processed by inspectors within 24 hours. We continue to work to ensure that all processes are automated and do not require the participation of an inspection officer. The absence of the human factor is an important component of the fight against corruption, in particular, and urban planning reform in general,” Chernyshev noted.
The Minister also stressed that the new principles of work of the State Inspectorate for Architecture and Urban Planning ensured the predictability of work. Consequently, groundless visits with checks on objects have ended.
